E-Sign Consent for Electronic Communications

SOVA Systems LLC (“SOVA”) may deliver certain communications, notices, agreements, billing statements, and disclosures in writing (“Communications”) in connection with the SOVA platform and related services (the “Services”). Your agreement to this E-Sign Consent confirms your ability and consent to receive Communications electronically from SOVA rather than in paper form, and to the use of electronic signatures in our relationship with you (this “Consent”). If you do not agree to this Consent or you later withdraw your consent, you may be restricted from using the Services.

Electronic Delivery of Communications

Under this Consent, SOVA may provide Communications electronically by email, by text message, by in-app notification, or by making them accessible through SOVA websites or applications. Communications include, but are not limited to:

  • Agreements and policies required to use the Services, including the Master Services Agreement, the Platform User Agreement, the Shipping Services Addendum, this Consent, and applicable privacy policies;
  • Payment authorizations, invoices, billing statements, and transaction receipts or confirmations;
  • Service-related notices, including security alerts, system notifications, maintenance notices, and updates regarding the Services;
  • Opt-in notifications and marketing communications (where you have opted in to receive them); and
  • Any other Communications that SOVA is required or permitted to provide to you.

SOVA may also use electronic signatures and obtain them from you as part of the Services.


System Requirements

To access and retain electronic Communications, you will need the following:

  • A computer or mobile device with internet connectivity.
  • For web-based Communications: a current version of a major web browser that supports TLS 1.2 or higher encryption, with cookies enabled. Supported browsers include the current and immediately prior major release of Google Chrome, Mozilla Firefox, Apple Safari, and Microsoft Edge.
  • For mobile application-based Communications: a supported Android device running a current version of the Android operating system with the SOVA mobile application installed from the Google Play Store, or a mobile device with a supported web browser as described above.
  • Access to the email address associated with your SOVA account.
  • Sufficient storage space to save Communications or a printer to print them.
  • If you use a spam filter that blocks or re-routes emails from senders not listed in your address book, you should add noreply@sovasystems.com to your email contacts.

If SOVA updates the system requirements in a way that creates a material risk that you will not be able to access or retain Communications electronically, SOVA will notify you and provide you with the opportunity to withdraw your consent without restriction or account termination.


Paper Delivery of Communications

You have the right to receive any Communication in paper form. To request a paper copy of any Communication at no charge, please contact us at legal@sovasystems.com or write to:

Requests should specify the Communication you would like to receive and should be submitted within 180 days of the date of the Communication. Requesting a paper copy of any Communication will not, by itself, be treated as a withdrawal of your consent to receive electronic Communications.


You may withdraw your consent to receive electronic Communications at any time by contacting us at legal@sovasystems.com or by writing to the address above. Withdrawal of your consent to receive electronic Communications may result in termination of your access to the Services, because the Services rely on electronic delivery of notices, agreements, and other Communications to function.

Any withdrawal of consent will be effective after a reasonable period for processing your request. SOVA will confirm your withdrawal and its effective date in writing (either electronically or in paper form).


Updating Your Contact Information

It is your responsibility to keep your email address and other contact information current with SOVA. You can update your email address through the Services or by contacting us at legal@sovasystems.com. If SOVA sends a Communication to the email address you have on file and that address is no longer valid, SOVA will be deemed to have provided the Communication.


SOVA may update this Consent from time to time to reflect changes in the Services, applicable law, or delivery practices. The “Last Updated” date at the top of this Consent indicates when it was last revised. If we make material changes, we will provide notice through the Services or by other appropriate means. Your continued use of the Services after the effective date of any change constitutes acceptance of the updated Consent.
