Mobile Alerts Terms

SOVA Systems LLC (“SOVA”) offers operational mobile alert services through the SOVA platform (the “Service”). By providing your mobile number and opting in to receive mobile alerts through the SOVA platform, you agree to these Mobile Alerts Terms (“Terms”). If you do not agree to these Terms, do not opt in to the Service.

1. What the Service Does

The Service delivers operational SMS and MMS messages from the SOVA platform to your mobile device. These messages are sent on behalf of the Customer (the hotel, property, or organization that operates the SOVA platform at your workplace) and are related to your role and duties. The Service is not used for marketing, advertising, or promotional purposes.


2. Message Types and Frequency

Messages delivered through the Service are operational and service-related, and may include:

  • Shift and schedule alerts
  • Emergency and safety notifications
  • Incident alerts and dispatch notifications
  • System notifications, including password resets and account alerts
  • Task assignments and checkpoint reminders

Message frequency varies depending on your role and your Customer’s configuration of the SOVA platform. Typical volume is approximately 5 to 15 messages per month, but frequency may be higher during periods of elevated activity. SOVA does not send marketing or promotional text messages through the Service.


3. Eligibility

By opting in to the Service, you confirm that:

  • You are the current subscriber or customary user of the mobile number you are registering, and you are authorized to incur any message or data charges that may be charged by your mobile carrier in connection with the Service.
  • The mobile number and any other contact information you provide is accurate and current, and you will promptly update it if it changes.
  • Your consent to receive operational mobile alerts is voluntary and is not a condition of employment or of any purchase.

You may not register a mobile number that is not your own. If SOVA discovers that the information you provided is inaccurate, SOVA may suspend or terminate your access to the Service.


4. Costs

The Service is provided at no charge by SOVA. However, standard message and data rates from your mobile carrier may apply. Contact your carrier for details about your plan. You are responsible for obtaining and maintaining your mobile device, mobile service, and any internet connectivity needed to receive messages.


5. How to Opt Out

You may opt out of the Service at any time by replying STOP to any message you receive through the Service. You will receive a single confirmation message acknowledging your opt-out request. Please allow up to five (5) business days for your opt-out to be fully processed.

You may also opt out by contacting your employer or property’s SOVA administrator, or by emailing privacy@sovasystems.com.

Opting out of the Service does not affect your use of other features of the SOVA platform. However, you may miss time-sensitive operational alerts if you opt out.


6. Changes to Your Mobile Number

If you change your mobile number or relinquish the number you registered with the Service, you must promptly notify your employer or property’s SOVA administrator so the old number can be removed. If you obtain a new mobile number and wish to continue receiving alerts, you will need to opt in again with your new number.


7. Privacy

Your mobile number and related information are processed by SOVA on behalf of your employer or property in accordance with the SOVA Services Privacy Policy. SOVA does not sell your mobile number or share it with third parties for their own marketing purposes. Your mobile number is used solely to deliver the operational messages described in these Terms.

8. Service Availability and Disclaimer

The Service depends on your mobile carrier’s network, your device, and third-party SMS delivery infrastructure. SOVA does not guarantee that messages will be delivered successfully, on time, or at all. Message delivery may be affected by carrier outages, network congestion, device settings, spam filters, or other factors outside SOVA’s control.

The Service is not a substitute for direct communication between you and your supervisor, your employer’s dispatch or command center, or emergency services (911). Do not rely on the Service as your sole means of receiving time-critical safety or emergency information.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” SOVA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, WITH RESPECT TO THE SERVICE.


9. Limitation of Liability

To the maximum extent permitted by applicable law, SOVA shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the Service, including damages arising from failed, delayed, or undelivered messages, regardless of the theory of liability.

To the maximum extent permitted by applicable law, SOVA’s total liability arising out of or relating to the Service shall not exceed one hundred dollars ($100). This limitation applies regardless of whether the claim is based in contract, tort, strict liability, or any other legal theory.

Nothing in these Terms limits any rights you may have under applicable law that cannot be waived or limited by agreement.


10. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising out of or relating to the Service or these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in San Diego County, California. Nothing in these Terms limits any rights you may have under the consumer protection laws of your state of residence that cannot be waived by agreement.


11. Changes to These Terms

SOVA may update these Terms from time to time to reflect changes in the Service, applicable law, or messaging practices. The “Last Updated” date at the top of these Terms indicates when they were last revised. If we make material changes, we will provide notice through the Service or by other appropriate means. Your continued use of the Service after the effective date of any change constitutes acceptance of the updated Terms. SOVA may discontinue the Service at any time.
